MISSION — A candidate for state representative could face charges of driving while intoxicated pending the outcome of a Mission police investigation.
A police officer detained Eddie Saenz, 47, under suspicion of driving while intoxicated either late Friday night or early Saturday morning, said Lt. Martin Garza, a spokesman for the Mission Police Department. Saenz announced his candidacy for state representative earlier this month.
The Edinburg engineer has challenged incumbent Aaron Peña in next year’s Democratic primary. The duo are competing to represent District 40, which covers most of Hidalgo County north of McAllen.
Garza said Saenz was “detained” on suspicion of driving while intoxicated but has not been arrested or charged with a crime.
Police expect to conclude the investigation and decide whether to charge Saenz by this afternoon. Garza said Saenz was not likely to flee and was therefore released on the condition that he turn himself in if he is charged. Police were not releasing the location or circumstances of the vehicle stop as of Wednesday evening.
Garza said the delay in deciding whether to charge Saenz is not unusual under the circumstances. He noted that the officer who stopped Saenz handled many calls that night and was unable to complete the incident report before the end of his shift.
Officials said politics played no role and the incident was handled according to normal procedure.
However, the missing report hamstrung the investigation, Garza said. Investigators received the report Monday or Tuesday, he said.
Saenz did not respond to a message left on his cell phone Wednesday evening. Kelly Fero, a member of his campaign, said he would release a statement, but The Monitor had not received it as of press time, and Fero did not respond to further messages."
This becomes just another part of the campaign bs we are going to hear because there will likely be no clear resolution. He will not be able to clear up this issue, it won't stop either the innuendos or public debate of what happened. I doubt that there is much chance of a conviction here, might not even be enough for an indictment. Too late for testing unless he submitted to either took a breathalzyer that night. Maybe if a filmed field sobriety test exists there is a chance for resolution one way or the other since I think all the patrol cars have cameras now(cynicism requires me to say the camera was probably broken too), the matter could be put to rest one way or the other. I bet the cell phone records for the night would be interesting.
I feel more sorry for the public because this lands in the hands of the Spin Doctors and we get to hear about this rather than the issues. I feel sorry for the Officer too because he will become the focus of scrutiny and possibly the scapegoat for why there is no evidence and if he allowed him to drive off with a warning.
Mission chief; arent you the same chief that had a family member killed because the people that were in the car were drunk? How can this sit well with you??
DWI- Standards in POLICE WORK:
1. Video tape mounted on police vehicle on during such stops at those hours of the night.
WHERES THE TAPE?
2. In the booking area, theres a video monitor monitoring the booking process.
WHERES THE TAPE?
3. Mugshots taken at Mission PD and County Jail during booking process.
WHERES THE PICTURES?
4. Transport of INMATE after araignment from local to county jail should be logged in at both areas.
WHERES THE PROOF OF THAT?
5. If a drunk driver is released, the person is released to someone who is sober.
WHO WAS THAT PERSON?
6. You cant "detain" a person on suspicion of drunk driving once they REFUSE a BREATHALYZER, or a STIGMA EYE EXAM is conducted to prove if the person is legally drunk.
THATS AN AUTOMATIC ARREST and SUPENSION OF LICENSE.
THE DWI IS ONE OFFENSE, BUT THE MASSIVE COVER UP IS WIELDING TO BE A MORE SERIOUS BLOW TO THE INTEGRITY OF SUCH CAMPAIGN.

MISSION – A prominent engineer currently running for state office is expected to turn himself into police later today on DWI charges.
Eddie Saenz, 47, made arrangements through his attorney to surrender to authorities by 2 p.m., Mission police Lt. Martin Garza said.
Officers stopped the Edinburg engineer under suspicion that he was driving drunk either late Friday night or early Saturday morning. However he was not arrested or charged with a crime at the scene.
Garza said the delay in deciding whether to charge Saenz was not unusual under the circumstances. Saenz was not likely to flee and the officer that stopped him handled several other calls that night, he said.

All this is bull! Yes, Saenz was arrested on the spot, it is procedure. Saenz refused to submit his specimen. And the officer did turn in the report on time, it is procedure before the end of every officer's shift and they keep of log of each report being submitted. So, Lt. Garza is lying about the report not being submitted on time. If it is politics taking over the situation is is a SAD thing. What if Saenz had hit a innocent family and killed or injuried someone, would they hide that evidence too? Let's be fair and charge everyone equally, not matter what political standing they hold.

Everyone here is making assumptions that it was the patrol officer who did not do his or her job correctly. These assumptions are being made based on information that was given to the reporter who wrote the story. Has anyone given any consideration to the fact that perhaps the officer really DID make the arrest, really DID book the person into jail after a breath test was refused, and really DID turn in his or her report in a timely manner? Could it be that the agency's administration elected to release the defendant on a personal recognizance release? Of course, not everyone gets this "special" treatment which is why the agency is now scrambling to come up with something to cover their actions once this special treatment was released to the media? I'm just throwing this out for consideration as a plausible alternative to what may have really happened.

What makes it more suspicious is that apparently Mission has a "normal procedure" where suspects are let go if they promise to turn themselves in if they are later charged. I know judges will do this. Uhmm. But that is called an arraignment after the person has already been arrested and charged with an offense. Are Mission cops enforcers and judges now? I mostly agree with citizen x. Seems to me it will be nearly impossible to get a conviction the way this case was handled. I will go further and even suggest another possibility. Given that this occurred in the Valley and this guy is running for office against a well known incumbent, it is possible that this guy is getting framed. Even the accusation could hurt his campaign. What? Whoa! Hold everything. Did I read the article right? This guy was detained and released on suspicion of DWI. Well, it doesn't work that way. Was he asked to provide a specimen of his breath? Did he provide it or did he refuse? Why wasn't he charged on the spot? Why wasn't he arrested? If you didn't follow through with the DWI investigation, how do you go back and arrest someone for it? Here's what I think. And it's just my view from what I read. The officer didn't handle the DWI according to procedure. The guy was probably just let go as a favor. Someone leaked the incident out to the media, and now they've come up with some bullzhit about how they are following procedure. I don't think so! Lt. Garza, let me ask you something about normal procedure. Do your officers handle all DWI cases this way or do they arrest the drivers on the spot? I really think you're full of it.

Monitor just posted!!Eddie charged with DWI. Bond was set at 5,000.00. His attorney (same as Omar's) says he will fight it.

Realty Check, i for one don't question that the man may be innocent, but strongly believe that he is not. however, what is in question is the treatment he received. if my brother had been detained, i am quite certain that he would have been taknen to jail and gone thru the entire procesws before being bonded out. come on Lt Garza, can't Mission Police Administrators do better than that? what a lame excuse for treating this man different than everyone else. as a former mission pd officer i know that is not NORMAL PROCEDURE. Normal procedure would be to detain him, offer him the breathalyzer and he either submits to it or not. if he refuses then his licnse is automaticlly suspended. officer writes report, turns in to supervisor for approve, suspect is then arraigned and taken to county jail. end of story. if that had been any other regular john doe, I guarantee he would not have been let go. PLEASE do try to come up with better EXCUSES, because that's what they are excuses. But we are used to seeing the rich, powerful, prominent, political, etc. get special treatment here in the valley.

This sounds like a lynching to me. “What happened to innocent until proven guilty”. Maybe we should all take a step back and get a reality check. Saenz is running for office he is in the public eye he has never been involved in any form of scandal nor has his name been dragged through the mud before, his record is impeccable and above reproach. The only negative publicity that he has ever received was when he was running for office against Aaron Pena for State Representative, and the slanderous and liable remarks made by Pena were proven wrong then and will be proven wrong now. The republican party certainly is going to a lot of trouble to plant dirt where there is none.

I certainly agree that there's a cover up with this incident. It's the Valley Way. I was a cop in one of the Valleys bigger cities and I experienced the wrath of the city and district for citing the driver and his passengers when I pulled them over for erratic driving. The driver was charged with DUI and the passengers for public intoxication. These men were all politicians in Hidalgo county. The driver and his passengers contacted the Chief of Police whom later that evening let them out of jail with no charges, charges dropped. I'm a firm believer that all people should be treated equal regardless of your social status. I was written up, later fired, and blackballed. However, it didn't stick when I later sued them. So a word of advice to all you peace officers reading this. Always do your job with integrity, morally, and follow the book of the law because that which comes around, goes around.

Heres my prediction on this Eddie Saenz DWI CASE:
1. Ric Salinas is Norberto Salinas' Son, so that being said, the Mission PD Chief will pull every string within the department to satisfy the Mayor or his son. SO EDDIE WILL BEAT THE RAP IN MISSION.
2. SO IF HE BEATS THE WRAP IN MISSION, THE POLICE OFFICER WILL RECANT ON HIS REPORT AND CLAIM HE DID SOMETHING WRONG IN THE ARREST AND THE CASE WILL GET THROWN OUT, LEAVING MR.SAENZ FREE OF ALL CHARGES. NO LICENSE SUSPENSION, NO FINES, JUST BIG ATTORNEY FEES. BECAUSE IT AINT BY ACCIDENT THAT RIC SALINAS IS HIS ATTORNEY IN MISSION. HELLO, THE MAYOR IS HIS DAD.
It may seem strange, but there would be no conflict of interest, because "legally" the mayor does not have a role in the dept. or the investigation. Not to say for the public there would not be a feeling of "too close for comfort" and not to say that the public would not feel the "Omar Effect" when they think of the issue, but this would only a public perception issue (more of an effect as to the election than the criminal case.
As for the chance of a conviction. Based on what we know now, looks like that stands the chance of a fart in the wind (maybe hurricane). With no arrest there will likely be either little evidence or enough to raise a "reasonable doubt of guilt" Hell the DA may not even prosecute the case if the evidence is not enough to see a chance of conviction. The catch-22 is that if he does prosecute some will say it is for political purpose.
Like I said the officer will be the scapegoat (since we don't know and may never know all the facts we will not know if this is right or wrong) We might get an internal investigation (those do so well) but the chief is on record now saying there was no procedural error. We could get a Ranger review, but where does that go.
No it looks like this will be the other prime issue of the campaign. But you know me I am a pessimist. But it you look on the brightside, maybe we can get a made-for-tv movie. Bad Boys, Bad Boys what ya goin to do ...what ya goin to do when hmm when they ask you to come by when you get a chance to talk to your consultant and your attorney (not very catchy)

Nobody is perfect and we understand that, but we the people don't have the luxury of covering up such things. HOW DID SAENZ GET HOME? If he in fact was given a warning, how did he get home? The citizens of Mission could of blamed the city's police department for letting a suspicious drunk driver go then. Things could of been worse.
